Cases and status

WP 17662/2022 -

 

Writ Petition filed by KEPL on KLAOCS and Government of Karnataka in the high court: Prayer by KEPL was to restrain KLAOCS from interfering in the maintenance of Klassik Landmark apartment. KLAOCS WON as the Writ Petition was DISMISSED by the honourable High court. The court observed that KEPL do not have any locus Standi in the KLAOCS matter, also made a strong remark on the ulterior motive of the party who filed the suit. 

WP/24636/2023

In high court filed by KLAOCS challenging the DRCS order in a case filed by KEPL in DRCS office : This suit was file against the erronous order passed by DRCS based on the petition filed by KEPL with misrepresenting details and HDFC bank put a debit freeze on association bank account based on a third party (KEPL) letter. High court in the first hearing stayed the DRCS order and also directed HDFC to lift the debit freeze immediately

MFA 8832/2023 filed by KLAOCS on KLAOA :

Prayer is to challenge the vacation of stay order on KLAOA AGM and rule passed by the them on us and to reinstate the stay and make the AGM and alleged rules of KLAOA null and void

Complaint filed before DRCS by KL Apartment owners

Complaint is filed to initiate penal action under section 14 of KOFA, 1972 against KEPL for not providing accounts as required under section 5 of KOFA, 1972. A notice and direct issued by DRCS to KEPL asking to furnish the audited account details immediately

Complaint filed before IGR and District Registrar by KL Apartment owners

Complaint is filed to initiate penal action under section 81 to 83 of the Registration Act, 1908 for wrongly registering the Deed of Declaration using fake POA and other fabricated documents by KEPL based on which the KLAOA association was formed…

OS 7445/2022 filed by KLAOCS disposed as withdrawn. This suit was filed when KLAOCS was denied access to use club house and man handled thier members. To make course corrections, KLAOCS withdrawn the suit and it is DISPOSED as per the IA filed by KLAOCS 

OS 2885/2023 

Defamation suit filed by KEPL against individual owners : Defamation suit filed by KEPL against individual owners who stood with KLAOCS for publishing land mortgage document (claiming it as forged) which "divided the undivided land" in 2023 post sale of 500+ apartments where each apartment owners have UDS across the project plant and several other points including factual google reviews put by apartment owners, internal apartment owners private chats etc. Matter is subjudice, pending trial 

OS 3302/2023 -

Suite filed by KL apartment owners and KLAOCS against the fake POA and DOD : Filed by KL owners and KLAOCS jointly challenging the Deed of declaration registered by using a fabricated fake Power of attorney by few owners in collusion with KEPL. Pending for disposal.

OS 222/2023 -

By KEPL against KLAOCS : Suit was filed by KEPL claiming trade mark infringement made by KLAOCS in using the name Klassik in its association name, whereas the association is created rightfully by apartment owners who co-owns Klassik Landmark title as per their sale deed. Also with several institutions pre-existing even before KEPL adapted its name Klassik name being generic. Case was DISMISSED by the honourable court

WA 1192/2022 -

Writ Appeal filed by KEPL on KLAOCS and Government of Karnataka in the double bench in high court challenging the order against them in WP17662/2022. Honourable double bench DISMISSED the Writ Appeal while granting liberty to approach appropriate forum

OS 1380/2023 -

By the KL erstwhile landowners : Case was filed by group of people who claimed themselves as the sole owners of the land despite of 500+ sales deeds executed. This case is a food for thought on the UDS which is said to have given to us by virtue of execution of the sale deed. If we own the UDS how are landowners approaching the court claiming as the sole owners of the land in Klassik landmark. Post arguments Court DISMISSED the case filed by Landowners on KLAOCS members and Apartment owners
